Longshore and Harbor Workers' Compensation Act and its Extensions

This practice group represents employers and insurance carriers in matters brought under the U.S. Longshore & Harbor Workers' Compensation Act and its extensions, the Defense Base Act, the Non-Appropriated Funds Instrumentality Act, the Outer Continental Shelf Lands Act and War Hazards Compensation Act. It is also involved in related maritime civil cases such as those brought under the Jones Act and Suits in Admiralty Act.

Representing employers and insurance carriers, the firm has appeared in every district office of the Department of Labor (OWCP) and has tried cases before Administrative Law Judges from coast to coast and in Hawaii. Its appellate practice includes arguing issues before the U.S. Courts of Appeal and briefs to the U.S. Supreme Court. Specialties involve coverage, concurrent jurisdiction (representing companies with claims pending simultaneously before state and federal forums) and protection of employers' civil, subrogation and credit rights. This practice group also renders opinions on issues ranging from compensability to insurance coverage.

The firm regularly sponsors seminars on timely topics. It also publishes guidebooks for handling cases under the Longshore & Harbor Workers' Compensation Act, as well as legal updates when there has been an important case or statutory developments affecting this area of the law.

Members of the Longshore & Harbor Workers' Compensation practice group have participated in the tri-annual Industrial Claims Association National Longshore Conference and have spoken at numerous seminars and conferences conducted by the Longshore Claims Association, Loyola University of New Orleans, and the Northwest Claims Association. They have also written a series in the California Workers' Compensation Enquirer, as well as articles for the firm's newsletter.

Jones Act

We provide litigation defense in claims brought under the Jones Act, Vessel Unseaworthiness, Death on the High Seas Act and Maintenance and Cure, for the merchant marine fleet, fishing vessels, tugs, barges, dredges, cruise ships, passenger vessels, and other related inshore and offshore maritime injury claims and indemnity actions in state and federal courts.
